Preamble

  1. The "Accademia Vivarium novum ETS" was founded in order to restore the great tradition of the Renaissance schools, their teaching methods, and the free and critical vision of the world that such an education fosters. The Academy is founded on the firm conviction that dignity (dignitas hominis) may be attained only by continuous self-examination. Its members are convinced that individual refinement can only be achieved by fruitful dialogue with those who have preceded us in our earthly sojourn, those whose voices can still be heard, and whose thoughts we can discover in the books they have left us. Foregoing any vague notions associated with the word "humanism," the Academy Vivarium Novum holds fast to a single primary aim: to guarantee students direct access to the immense cultural heritage of classical, medieval, Reinassance, and post-Reinassance texts which have been passed down in the languages that are the foundation and the vehicle of western culture.
  2. The Student affirms knowledge of the goals pursued by the Association and of its rules of procedure, accepting them without exceptions or reservations as regards them.

Art. 1) Preamble.

The preamble forms an integral and substantial part of this Act.

Art. 2) Terms and Objective of the Contract.

The objective of this contract is the Student’s participation into the Academy’s courses, either in its campus settled in Frascati or through an e-learning platform and other online tools.
The providers of this Course are the Academy as a whole and the Instructors; the former, for all intents and purposes, creates the Course and organizes it, selecting the content and the teaching methodology. The Student will be presented with various activities according to the modality of the course, including, but not limited to classes, composition and the distribution of related materials, exercises and practical workshops, and tutoring and procedures for verification of learning.
The Student declares a good understanding and acceptance of the following:

  1. Applications are only accepted via the official Website (www.vivariumnovum.net) by submitting the completed Application form, followed by payment by credit card or wire transfer. The Application will be considered provisional until the deposit has been paid. Following the provisional Application, the Student will receive information about payment options. The Student cannot derive any rights from a provisional Application.
  2. By submitting the Application form, the Student declares to have received these norms and conditions and in addition declares agreement with its contents.
  3. Registration closes on the date indicated on the Website. This date can be extended if there are still places available, which is left to the discretion of the Course provider.
  4. The day that the Course deposit is paid will be considered the date of Registration.
  5. The Student declares to have read, prior to participation in the Course when purchasing the product online, all the information contained in the course description accessible on the site and from which the main features of the Service, the geographical address and identity of the Academy, and the price and payment methods are evident.

Art. 3) Placement and Admission.

  1. In the event of Registrations in excess of the number of available places, the Course provider reserves the right to close Registration before the designated date. Any changes will be announced on the Website.
  2. The Academy reserves the right to examine the Student’s starting level in order to assess compatibility with the Course. If the Academy finds that the Student’s starting level is insufficient, it may decide not to admit the Student to the Course. The Academy might offer a place in a less demanding Course, depending on availability.

Art. 4) Cancellation on the Part of the Academy.

  1. The Academy reserves the right to cancel the Course. The Academy will, within one week after the closing date for Course Registration, either in writing or by e-mail, inform participants of any possible cancellation due to insufficient applicants.
  2. If the Academy believes the admission of a Student not to be possible, or if the Academy has cancelled the Course, the Registration will be annulled without any costs and Course fees already paid will be reimbursed as soon as possible.

Art. 5) Cancellation on the Part of the Student – Right to Withdraw.

If the Student cancels, interrupts, or ends the Course prematurely, the financial burden will be as follows:

  • Cancellation more than 30 days before the start of the Course: the Student will pay 30% of the full Course fee.
  • Cancellation within 30 days of the start of the Course: the Student will pay the full Course fee.

Art. 6) Terms of Payment.

  1. The Student declares to know and accept that the Academy must have received the Course fees due before the first session of the Course in order to allow the lessons to take place. The payment options are detailed on the website “www.vivariumnovum.net" under "Language courses".
  2. If the Course fee is not paid on time, the Academy will be authorized to ban the Student from the Course until the owed sum has been received.

Art. 7) Course Expectations.

  1. The Student expressly declares and accepts the following. It is important the Student take responsibility for the Student’s own role in learning growth and development. The Academy is committed to helping the Student progress, but cannot ensure that the Course objectives will be met without the Student’s active and willing partnership.
  2. The Student is expected to attend all classes punctually in order to guarantee the success of this learning method.
  3. The Student must complete all assigned homework in a timely manner and participate in all classroom activities and exercises in order to ensure learning progress.
  4. The Student’s use of languages besides Greek and Latin is not permitted during class, as it impedes learning progress. The teaching methodology is designed to begin at a very basic level, enabling students with no previous experience to read and converse from the beginning, even with the simplest of sentences.

Art. 8) Expected Behavior.

  1. The Academy expects the Student to observe standard etiquette in order to maintain a fruitful learning environment rooted in mutual respect. Students who persist in violating these norms after being asked to desist may be expelled from the Course.
  2. The Student is asked not to interrupt peers or teachers while they are talking.
  3. No obscene or offensive speech, gestures, deriding of peers, or unwanted disruption of the classroom environment will be tolerated.
  4. The Student is not permitted to record lectures through video recordings or audio recordings, or screenshots.

    For online courses:

  5. The Student is asked to present a relatively neat background on camera in a place where passers-by will not be visible or audible during class.
  6. It is requested that the Student maintain an appropriately professional dress code, as for a regular class or work environment.
  7. Screen sharing is not permitted on the part of the Student, unless requested by the teacher.
  8. The Student is asked not to browse online or complete other tasks while class is in session.
  9. The Student must keep the camera on while in class.

    For on campus courses:

  10. The Student agrees to observe the attached Rules and policies for visitors staying on campus, that is an integral and substantial part of this Act.
  11. The Student agrees to observe the attached Dress code, that is an integral and substantial part of this Act.

Art. 9) Technical Requirements for the online courses.

  1. The Student must create a free Zoom video-conferencing account before the start of the Course.
  2. The Student must have regular access to a computer with a microphone, webcam, headphones, and broadband connection of at least 10 Mbps download speed and 5 Mbps upload speed in order to participate.

Art. 10) Educational Materials.

The Student will need to purchase the necessary Course materials in the Student’s respective country.

Art. 11) Intellectual Property Rights.

  1. The intellectual property of “Accademia Vivarium novum ETS,” including, but not limited to, educational materials, questionaries, tests, exercises, songs, books, and multimedia content used in its Courses, may not be downloaded, copied, or distributed to third parties under any circumstances without the express written permission of the Academy.
  2. Furthermore, the Student commits not to film and/or record the Courses and/or the educational activities in general in which the Student will take part, which is expressly forbidden and not permitted.
  3. The Students acknowledges that all parts of the Courses of Study laid out in the Academy's main website or in any other form, such as internet pages, mobile device applications (app) or any other form (which are hereinafter referred to as "Site" for brevity) are the exclusive property of the Academy, including, but not limited to, logos, images, texts, and course content, of which, pursuant to the current Italian Law 22.04.1941 no. 633 (Copyright Law), where applicable, the commercial use by third parties, partial or total reproduction, and reworking and transmission in any form and by any means, unless with prior written permission from the Academy, is strictly forbidden. It is forbidden to copy, distribute, publish, or otherwise use or exploit the Course material without the Academy’s prior written consent. The student, being responsible for the safe-keeping and confidentiality of the assigned Course access credentials, and as the holder (resulting from enrolment in the Course) of a personal and non-transferable right to access a restricted area of “Accademia Vivarium Novum ETS,” commits not to allow third parties to use and/or view these Services in any way, refraining from performing any act that would violate the aforementioned Academy’s exclusive and proprietary rights; as well as indemnifying and holding the Academy immune from any claims and/or demands deriving from third parties’ use and/or abuse of these Services. In the event of violation of the specified obligations, this contract will be considered terminated by law and the Academy will be free to take legal action to protect any rights violated, including compensation for damages suffered. In addition, if the Academy deems there to be an existing or highly probable security or unauthorized-use issue, it reserves the right to suspend the Student’s Course access credentials.

Art. 12) Privacy Statement.

  1. By participating in the Academy’s online Courses, the Student agrees to being video- and audio-recorded by the Academy solely for the institution’s educational, promotion and safety purposes.
  2. The Student allows the Academy to use the Student’s personal data. All personal information provided to the Academy is treated with the utmost care and is carefully processed and protected according to the European General Data Protection Regulation (EU 2016/679).

Art. 13) Conclusion of the Contract.

Pursuant to Article 1326 c.c. (Civil Code), this distance contract is understood to be concluded at the moment when the Academy (and for it, the Operators responsible for receiving data and communications related to the conclusion and execution of the contractual relationship) becomes aware of the Student’s adherence to the educational offer, as evidenced by the Student’s online Registration for the Course. The Student, having completed the Registration process and paid the Course fee in full, will receive the credentials necessary to access the online classes and the online learning platform where all didactic material will be available.

Art. 14) Responsibilities and obligations.

Except in case of wilful misconduct or gross negligence, the Student expressly exonerates the Academy from liability for direct and indirect damages:

  1. that the Student or third parties might suffer in relation to, or because of, the delivery of educational Services, lessons, or disruptions thereof;
  2. that the Student or third parties might suffer because of faulty connectivity on behalf of the telecommunications network provider, the Student’s use of low internet speeds technically incompatible with the online learning platform, or the Student’s failure to attend the Course as a result of technical issues that arise during the Course;
  3. caused by third parties illegally accessing the online Course due to a lack of caution on behalf of the Student in keeping login and password information secure, or the absence of other security measures that the Student ought to adopt.
    In no case shall the Academy be held responsible:
  4. for the Service’s malfunction due to telephone-line, power-line, or internet failure, overload, or interruption;
  5. for third-party failures that undermine the use of the Service, including, but not limited to, slowdowns in or failure of the telephone lines and computers that manage internet traffic between the Student and the educational platform providing the Service;
  6. for the Student’s fraudulent and/or improper use of credit cards.

Art. 15) Information and Consent to Treatment of Personal Data Pursuant to GDPR 679/16.

The Student declares to have been informed in advance, for consent purposes, about:

  1. the purposes and methods of personal data processing;
  2. the obligatory or optional nature of data provision;
  3. the consequences of not communicating certain data;
  4. the entities or categories of entities to which personal data might be communicated, or which could become aware of this data as responsible for it or in charge of it, and the scope of disseminating this data;
  5. the rights reserved to the Student;
  6. the Data Controller’s identification details. In particular, with regard to the aforementioned points, it is important to note that the collected personal data will be processed in order to allow Registration for and provision of the Service. The provision of personal data and consent to their processing is therefore necessary to complete the enrolment procedure. Thus, the Student consents to processing of personal data and their communication to third parties for all purposes and means necessary for the implementation of the contract to its complete execution, and for any potential legal action. The data provided at the time of Registration and payment of the respective course fee will be processed by the Academy in full compliance with current privacy regulations, as well as:
    a. to publish the Student’s ideas, comments, and sentences related to the object of the Site, as well as the material and all other information provided by the Student on the Site all in full compliance with the Site’s Conditions of Use and Access; which publication could be associated with a pseudonym (“username”) selected by the Student and whose selection (potentially detrimental to the interests of third parties) will be exclusively the Student’s;
    b. to send newsletters;
    c. to send responses to requests made through the form on the “Contact” page to the email address indicated by the User;
    d. to manage content that the User voluntarily includes on the Site;
    e. to send invitations related to events;
    In regard to the previous points, the Data Controller in charge of personal data processing is Prof. Luigi MIRAGLIA and “Accademia Vivarium Novum ETS” with legal headquarters in Naples at Piazzetta Riario Sforza no. 159, and a secondary seat in Frascati (RM) at Viale Borromini no.5, in the Villa Falconieri.
    Personal data will be processed by the Academy, using automated and manual electronic instruments for the proper performance of the task according to the rationales indicated above, so as to ensure the security and confidentiality of the data.
    In regard to the preceding points, moreover, personal data might be communicated to individuals in charge of realizing the Service in order to achieve the aforementioned goals.
    In relation to the above, the Student is entitled to access personally-relevant data at any time, and to exercise any other rights provided for, by writing to the Academy at privacy@vivariumnovum.net with a request for the source of the data, any corrections, any updates on or integration of inaccurate or incomplete data, a request to erase or block data processed in violation of the law, or to oppose their use for legitimate reasons to be explained in the request.
    Finally, the Academy recognizes the need to provide additional privacy protection measures for personal data provided by Student who are still minors. A Minor’s registration is subject to the concurrent provision of some personal data by a Parent or Guardian who can authorize the Registration. The Parent or Guardian’s personal data and the personal data of the Minor registered on the Site will not be disclosed. Some of the functionalities of the Course might include age-based access restrictions so as to impede use by the Minor or to protect the Minor’s personal data. When the Minor’s personal data is collected, the following additional steps are taken to protect the Minor’s privacy:
  7. notifications are sent to the Parent or Guardian about the processing methods for the Minor’s personal data, including the kinds of data collected from the Minor, how they might be used, and the parties with whom they might be shared;
  8. Parent or Guardian consent is obtained for the collection of the Minor’s personal data, or in order to directly send the Minor information about activities;
  9. the collection of the Minor’s personal data is limited to what is reasonably necessary for participation in online activities;
  10. the Parent or Guardian is allowed to request access to the Minor’s personal data and request that the information be modified or erased;
    The Academy reserves the right to conduct random checks on minors registered on the Site in order to verify the Parent or Guardian’s personal data as entered by the Minor at Registration. Finally, the Academy reserves the right to make changes to this Privacy Policy in order to take into account new technologies, best practices, and legislative requirements, or for other purposes, with due notice to the User in case of significant modifications that might require the User’s explicit further consent.

Art. 16) Final Provisions.

  1. The Student accepts and declares that if, for any reason, the course does not take place, including an instance of force majeure, the Academy will not compensate the Student in an amount in excess of the total Course fee.
  2. In the event of violation of the terms of this contract by the Student, the Academy reserves the right to suspend or expel the student from the Course without reimbursement.
  3. In a case where the terms and conditions of Registration do not provide for a course of action, the Academy’s director will decide on a reasonable and fair solution to the issue.

Art. 17) Jurisdiction.

The Parties declare and accept by mutual agreement that any disputes concerning the interpretation and execution of this Contract are within the jurisdiction of the Court of Velletri, excluding elective courts. The Parties also declare and accept by mutual agreement that the Client-Consumer’s domicile is not applicable in this case, as pertains to Decreto legislativo (Legislative Decree) 6 September 2005 no. 206 (Consumer Code). The exclusive area of jurisdiction is the Court of Velletri, to the exclusion of all other courts.

Art. 18) Final Clauses.

The obligations and commitments deriving from this Contract, which are inherently in effect even after its expiry date, shall remain valid and effective after that date, until their discharge.
